The Court of Labour Appeals of the First Judicial Circuit of San José has confirmed that the relationship between Uber drivers and the company is of a working nature in Costa Rica.
In 2023, a former Uber driver filed a lawsuit against the company. The driver had worked for the platform between October 2019 and February 2023 when they were suddenly and unjustifiably disconnected from the app.
The judge ruled in favour of the former driver based on the principle of subordination. This is because orders are given, decisions are made and sanctions are applied to drivers through the platform.
The company appealed against the initial ruling, which the Court of Appeal has now confirmed in full.
