Migrant Workers in Finland Left in Limbo, After Finland Court Rules Couriers Are Employees

In May, the Finnish Supreme Administrative Court ruled that food couriers working for companies such as Wolt are employees rather than self-employed entrepreneurs. This overturns a previous ruling by a lower court, which recognised that couriers are subordinates of the platforms since their independence was only partly illusory.

A month later, Wolt hasn't changed its business model, and migrant couriers are still waiting for clarification. If they are no longer formally recognised as entrepreneurs, they cannot be granted a residence permit based on that status. They must therefore either withdraw their application or present an alternative business plan to the Centre for Economic Development, Transport and the Environment, which evaluates entrepreneurs' plans when they apply for residence permits.
