February 2025 - Brazil - Uber's Public Civil Action Dismissed Without Merits, Avoiding Ruling on Employment Relationship and R$1 Billion Fine

The public civil action (ACP) in which Uber was initially ordered to recognize the employment relationship of drivers registered on the platform, as well as pay a fine of R$1 billion for collective moral damages, was dismissed without addressing the merits of the case.

The Tribunal Regional do Trabalho de São Paulo stated that the employment relationship must be proven by each worker, and that to consider the activity of an Uber driver as the only employment model would be tantamount to legalising other fraudulent forms of work.
