iFood could face a fine of R$10 million, along with an additional R$10,000 per unregistered delivery worker, for failing to comply with the CLT (Consolidation of Labour Laws), according to a request made by the rapporteur, Ricardo Nino Ballarini, in a public civil lawsuit filed by the MPT (Public Ministry of Labour). The case was heard by the 14th panel of the TRT-2 (Regional Labour Court of the 2nd Region) in São Paulo on November 2021.
The judge supported the idea of an employment relationship between the delivery drivers and the platform, noting that, while there are aspects of self-employment, the workers experience subordination to the app, which controls their earnings and work routes.
The case was suspended by Judge Fernando Álvaro Pinheiro following a request for more time for review. It is expected to be reconsidered on December 5.
