The Mato Grosso do Sul courts have ruled that Uber must reinstate a driver to its platform, citing the suspension as unjustified.
The driver, who had been active on the platform for over four years and completed more than 3,000 highly rated rides, was suspended in January 2024. Uber cited a criminal record as the reason for the suspension, but the driver provided clean background checks and challenged the lack of prior notice, which violated the terms of the membership agreement.
The suspension caused significant hardship for the driver, who relied on the platform as his primary source of income. After unsuccessful attempts to resolve the matter through Uber’s administrative channels, he filed a lawsuit.
In his decision, Judge Paulo Afonso de Oliveira stated that Uber failed to demonstrate any contractual violation to justify the suspension. “The defendant’s unlawful actions abruptly deprived the plaintiff and his family of their means of livelihood, without prior notice,” the judge remarked.
