After only a few months of discussion, the Mexican labour reform for digital platforms, which recognises labour rights and establishes criteria for access to social security for app-based delivery riders and drivers, will come into force in June 2025.
It was published in the Official Gazette of the Federation (DOF) on Christmas Eve.
Under the reform, app-based delivery riders and drivers will have full access to social security and labour rights if they earn an income equivalent to the minimum monthly wage.
Workers whose income does not reach the monthly minimum wage will be considered self-employed, but will be covered by the rules on disconnection.
In addition, all individuals will be protected against accidents during the working day, regardless of their income.
Effective working time is defined as the time when a job or trip is accepted and completed.
The PTU (Workers' Participation in Profits, a labour benefit in which companies share a percentage of their profits with their workers, provided that it exceeds 300,000 pesos of declared income) applies to delivery drivers and drivers who work more than 288 hours per year, which is counted as effective working time.
