The Bigger Picture: New Labor Reform Aims to Regulate Social Contributions for Gig Workers

Platform workers can be classified as either employed or self-employed, according to the latest Reforma Laboral. Approved by part of Congress in mid-June, the bill still needs to pass three more debates before it becomes law.

A specific section addresses "workers connected through digital delivery platforms" and outlines their treatment based on their status.

If classified as self-employed, the company must pay social security contributions according to legal proportions, including part-time contributions. If classified as an employee, the digital platform company will cover 60% of health and pension contributions, with the worker responsible for 40%. The employer is responsible for both affiliation and payment regarding occupational hazards.
