December 2022 - Italy - 'The rider is an employee': the Labor Court of Milan forces Glovo to hire him

The Labor Court of Milan ruled that the rider who was fired for an alleged illegal act during his shift has to be reintegrated under the label of employee, and has to benefit from the trade national collective agreement.

Now Glovo must pay him around 1,400 euros per month, reimburse salaries and contributions for the year of stoppage, and take charge of the costs of the trial.

The judge referred to an interpretation of the Jobs Act, already sanctioned by the Court of Cassation in 2020 in the trial against Foodora.

Workers who participate in the activity of a company on an ongoing basis and are organized by the same "with reference to the times and places of work", are entitled to benefit from the same conditions as subordinate workers. The Labor Court of Milan has taken a step forward, recognizing all the employment rights to the rider.
